A critical administrative and functional situation has arisen in the Autonomous City of Buenos Aires (CABA). The National Supreme Court of Justice (CSJN) issued a resolution designating the Superior Tribunal of Justice of CABA as the superior reviewing body for rulings from the national jurisdictions (Penal, Civil, Commercial, and Labor) based in the city. However, magistrates from the Labor jurisdiction, along with their counterparts in other national jurisdictions, have refused to comply with this order. The National Appeals Court of Labor issued a resolution (No. 4 of 02/12/2025) with biased arguments, rejecting any motions from litigants and stating that only the CSJN has authority over them. This perceived "egotistical" stance by the Labor judges suggests they prioritize their own status over the justice needs of the people. This refusal to obey the CSJN, one of the three branches of the Republic, creates significant uncertainty. It raises questions about accountability: if a party receives and withdraws funds based on a ruling that is later overturned by the STJ CABA, who is responsible for returning the money? The situation highlights a severe disregard for the justice system, criticizing the judge selection process, political patronage, and the lack of individual free thinking among magistrates. The core issue is how the CSJN can enforce its rulings and ensure the judicial system functions with the necessary agility, or if litigants will continue to be the "hostages" of this system. The National Council of the Judiciary may need to intervene and question the judges who refuse to comply with the CSJN's decision.
